Chapter 13 Bankruptcy Reorganization Attorneys
This is the second most common type of bankruptcy filed in the United States, with roughly 38% of bankruptcy cases falling under this chapter. It is often referred to as a restructuring or reorganization bankruptcy. Unlike the short duration of a Chapter 7 case, a Chapter 13 typically takes between 36 and 60 months to complete.
In this type of bankruptcy, the individual is required to make monthly payments to a trustee, who then distributes the funds according to a plan developed with your attorney. Chapter 13 is not just for individuals who do not qualify for Chapter 7. Despite a common misconception, you are not required to pay creditors in full.
Chapter 13 allows you to do several things that are not available in Chapter 7, including but not limited to: reinstating a mortgage to avoid foreclosure and loss of your home, paying off vehicles under restructured terms, retaining property that would otherwise be lost in Chapter 7, and, in some cases, eliminating second mortgages.
A Chapter 13 bankruptcy also provides a broader discharge than Chapter 7, allowing you to eliminate certain debts that may not be dischargeable in a Chapter 7 case.

- 401K, IRA or any Pension and Retirement statements for the most recent quarter prior to filing

- List of all debts –all debts that may not be on the credit reports
